The Center has increased the jurisdiction of the Border Security Force (BSF) to check terrorism and cross-border crimes. BSF will now be able to conduct search operations up to 50 km inside Indian territory along the international border with Pakistan and Bangladesh. It will also have the right to arrest suspects and seize suspicious material. For this he will not need to take permission from any administrative officer.

What is the new order regarding BSF?

The Union Home Ministry has changed the jurisdiction of BSF. This change has been made on the basis of the provisions made under section 139(1) of the BSF Act 1968. These changes are related to 12 states of Gujarat, Punjab, Rajasthan, West Bengal, Assam, Manipur, Mizoram, Tripura, Nagaland and Meghalaya, Union Territories of Jammu and Kashmir and Ladakh. Out of these, only three states are Assam, West Bengal and Punjab where the jurisdiction of BSF will increase much more than before. In these states, earlier the BSF could act up to 15 km from the border. Now she will be able to take action for 50 kilometers without a magistrate’s order or warrant.

Talking about the rest of the states, in the five North East states of Manipur, Mizoram, Tripura, Nagaland and Meghalaya, BSF will have the right to take action in the entire state. Similarly, BSF can operate anywhere in Jammu and Kashmir and Ladakh. The scope of BSF’s action in Gujarat has reduced. Here earlier she could act within a radius of 80 km from the border. Now it has come down to 50 kms. At the same time, this order will not have any effect in Rajasthan. Here the radius of BSF’s jurisdiction will remain as before, 50 km.

Actually, BSF has the responsibility of protecting India-Bangladesh and India-Pakistan border. Under this, the BSF has been given the right to act up to a certain distance from the international border. This jurisdiction is different in different states. After the BSF’s jurisdiction is over, the responsibility of further security lies with the state police or any other force.

The scope of BSF has increased in three states, why opposition in two?

The rights of BSF have increased in Assam, Punjab and West Bengal. Of these three states, only Assam has a BJP government. So there is no such opposition there. At the same time, there are governments of other parties in West Bengal and Punjab. These governments are calling this decision of the Center an attack on the federal structure.

Has there been any change in the rights given to BSF?

  • According to news agency ANI, even the lowest rank officer of BSF can take action under CrPC without a magistrate’s order and warrant.
  • That is, the officer of BSF now has the right to arrest any person who is involved in any cognizable offence, or against whom a proper complaint has been made, or credible information has been received from sources.

What action can BSF take in its field?

The BSF has powers of search, seizure and arrest under central laws such as the Passport Act, the NDPS Act and the Customs Act.

Why has politics heated up after this decision?

Law and order is a state subject in the federal structure of the country and the states can make laws on it. On this basis, the states are opposing this change.

  • The Chief Minister of Punjab has said that this is a betrayal with Punjab. After this decision, more than half of Punjab will go under the control of the Central Government on the pretext of BSF.
  • Captain Amarinder Singh is in favor of the Centre’s decision. The Captain said that the decision to increase the scope of BSF should be appreciated. As the threat of drug smuggling and terror is increasing in Punjab, now Punjab will be safe with this decision.
  • West Bengal Transport Minister and TMC leader Firhad Hakim said that the central government is violating the federal structure of the country. Law and order is a state subject, but the central government is trying to intervene through central agencies.

According to retired Lieutenant General Vinod Bhatia, this change was being demanded for a long time. With the BSF having less jurisdiction, there was a problem in coordination. Also there was another problem. Suppose an infiltrator is entering India from across the border. The BSF had the authority to act only up to 15 km, but the intruder used to enter India after completing a 15 km journey in one night. This change will also solve this problem.
